A trademark is the foundation of your brand since it enables consumers to identify your goods and services. It can be a word, phrase, symbol, action, three-dimensional, smell or sound, etc that helps the consumers associate products with the source.

Here are some reasons why trademarks matter and what the hazards are of not having one.

A trademark can help you:

  • Set up brand image and reputation. A business mark is a central aspect of your brand identity and marketing. When registering a mark, don’t forget to have in mind a distinctive (namely, unique and memorable) mark that cannot be confused with your business competitors.

  • Avoid rebranding and infringing on other trademarks. If your mark is not registered, there is always a chance that you may be infringing on another company’s trademark. In the worst case, you may need to rebrand, which is a waste of money and time. Furthermore, your credibility and reputation may be deeply affected. With a registered trademark, you will have legal certainty even when a company claims you are infringing on their trademark.

  • Prevent others from copying you. Registered trademarks are easier to enforce. They give you the exclusive right to use your mark and prevent others from using it and take advantage of your investment. Registration reinforces the position of the holder in case of litigation.

  • Generate income. Trademarks can be sold or licensed, which can be a source of income.
