[FAQs] When Is the Trademark Registered and Protected?

Summary

Once an application is examined and found to be eligible for registration, a decision of registration is issued.

          In case the application for a trademark satisfies all the requirements for registration as a result of the examination, the application will receive a Decision of Grant Protection. This is the administrative measure which means the applicant can receive establishment registration of a trademark right.

 

          Upon the decision of registration, the applicant must pay a registration fee. To date, the official registration fee in Korea is  211,000 KRW (near 190 USD). This official fee should be paid within 2 months from the date of the notification of allowance. Just after that, the trademark is finally confirmed and is now protected. 

 

          The term of trademark protection in Korea is 10 years from registration, and it is renewable an unlimited number of times every 10 years.
